A Thug who jumped on a nightclubber's head with both feet as his victim lay helpless in the street has been jailed for nine months. James Milligan shouted racist abuse as he carried out the attack on Imran Ali after an incident in Senorita's night club in Weston-super-Mare.
Bristol Crown Court heard yesterday that Milligan decided to take the law into his own hands because he believed his victim, who was too drunk to defend himself, had hit a woman, which he had not. The scenes published by the Evening Post today were captured on CCTV cameras, whose operators helped bring Milligan to justice by directing police officers on the ground to him. The 21-year-old, of Frankley Green, Birmingham, pleaded guilty to a charge of racially aggravated assault causing actual bodily harm following the incident in June. James Haskell, prosecuting, told the court Mr Ali had met two female friends and had been celebrating one of their birthdays in bars and clubs in the resort. Mr Haskell said they had gone to Senorita's and there had been an incident involving another woman who pretended to pour a drink over Mr Ali. She was pulled away from him by one of his female friends. Outside the club, the same woman then poured a bottle of drink over Mr Ali and punched him in the face. When one of Mr Ali's female friends remonstrated with her again, a group of men arrived and accused Mr Ali of hitting the girl who had poured the drink. Mr Haskell said: "Mr Ali was heavily intoxicated and was in no state to defend himself. "He was surrounded by males and the CCTV shows the defendant approached Mr Ali from behind, punched him and knocked him to the floor. "The defendant kicked out at his legs and he fell to the floor again. "The defendant then jumped with both feet and landed on the victim's head causing his head to impact on the road." The court heard that Milligan aimed a second kick that missed and Mr Ali was able to run off, clearly disorientated, with his shirt ripped. CCTV operators called police and were able to direct them to Milligan. The court heard Milligan raised his hand when approached by officers. Officers hit him with a baton across his right shoulder, he was pushed to the ground and arrested. In interview, Milligan said he heard a woman insulting Mr Ali, assumed Mr Ali had struck her and wanted Mr Ali to apologise. He accepted carrying out the assault but not to the extent recorded by the CCTV. Mr Ali suffered a cut near his left eye which needed stitching and cuts to his forehead, back, arms and neck. Milligan had previous convictions for dishonesty, driving offences and resisting a police officer. Alan Fuller, defending, told the court his client did not have a single offence of violence in his record. He said "He is not a violent person. He entered a timely guilty plea for an offence very much out of character. In his interview he wasn't thinking properly. "There does appear to have been an incident involving Mr Ali and his female companions who were all heavily in drink getting involved in a dispute with another female, in which violence was used." Mr Fuller added that Milligan realised he had done something stupid in drink and in anger but presented as a contrite and polite person who is not the sort of man the court normally dealt with. Imposing the sentence, Judge David Smith QC told Milligan: "I have looked at this video and these are very serious allegations. "You got involved in an incident that was none of your business. "You bring a man to the ground, you jump onto his head and you aim a vicious kick at him which you missed. "At the time you were shouting racial abuse." |
